📜 Terms of Service
Plain version: we’ll tell you in writing what you’re buying, what it costs and what we’re targeting. We make no promise of specific business results unless it is written in your agreement.
🧾 Quotes & agreements
Prices shown are in Canadian dollars (CA$) and exclude applicable taxes (GST/PST) unless stated. Website prices, timelines (such as a “target go-live in about 30 days”) and scopes are estimates until confirmed in your written agreement. Plans are month-to-month with no minimum term; either side may end with 30 days’ notice.
🛡️ 90-Day Results Guarantee
- Before work starts we agree in writing on 2–3 measurable targets (for example, a response-time target or after-hours coverage). Only those written targets are covered.
- If a target is not met within 90 days of go-live, you may ask for a refund of the fees you paid us for the affected service. Send your request in writing within 14 days after the 90 days end; we confirm and refund within 30 days.
- It does not apply if targets are missed because of matters outside our reasonable control, such as your not giving needed access, content or approvals, third-party outages, changes you or others make to the setup, or unpaid invoices.
- It is a refund of fees only. It does not cover lost sales or indirect losses, and is not a promise of revenue, leads or any business result.
- We back up your website before we install anything.
🎁 Free & promotional offers
- Offers (the Free Gift video credit, the free Lead-Leak Review, the free first month of monitoring on the Starter plan, partner introductory offers) are limited as described on the page where they appear, are for new clients or applicants, and cannot be redeemed for cash or combined unless stated.
- Free Lead-Leak Review: a one-page, AI-assisted review emailed within 2 business days, based only on what is publicly visible on your website. It is general information, not a guarantee of results.
- Free first month (Starter): the monthly monitoring fee is waived for month one once the setup fee is paid; billing starts in month two.
- “Package value” figures on the Gift page are our estimate of comparable work, not a previously charged price.
- We may decline or end an offer at its stated deadline, or if a claim is incomplete or unlawful.
🤖 AI features & your responsibilities
- Our services use artificial intelligence, which can make mistakes. Output should be reviewed by you before you rely on it. AI tools talk to your customers on your behalf only as set up with you.
- Where AI chat, voice, video or imagery is used with the public, you and we will disclose it as the law requires. AI is never used to invent real people, reviews or testimonials.
- Calls & recordings: if call recording, transcription or AI voice agents are used, you are responsible for giving the notices and obtaining the consents your customers are owed under the law where they are located. We will help set up the notices.
- Marketing messages: you must have proper consent (including under CASL) for any email, text or calls sent through the tools we set up.
- You confirm you own or may use everything you supply (text, files, names, faces, voices, recordings), and that anyone shown has given written permission.
⚕️ Regulated industries
Our industry pages (for example medical, legal and safety) describe how AI tools can help with documentation and workflow. We do not provide legal, medical, financial, safety-certification or compliance advice, and we do not claim our services meet HIPAA, PHIPA, PIPEDA or any other regime unless that is confirmed in writing for your project. You remain responsible for compliance in your own business.
🤝 Reseller & referral program
- Partners are approved individually and bound by a separate partner agreement before earning commission.
- Commission (such as 10% of eligible monthly fees) is paid only on fees we actually receive from clients you referred, for as long as they remain active, and ends if the client cancels or stops paying.
- Earnings are not guaranteed. Examples are illustrations only, not a promise or typical result. Many partners may earn nothing. There is no fee to join and you are not required to recruit other partners or buy anything.
- Introductory offers (for example, free months for the first 25 approved partners) apply only as stated at sign-up. The partner dashboard and training library are still being built; until then we send monthly statements by email.

⚖️ Liability, law & contact
- The site and free materials are provided “as is.” To the extent allowed by law, GenXwest is not liable for indirect or consequential losses, and our total liability for any service is limited to the fees you paid us for it in the prior 12 months. Nothing here limits rights you have under law that cannot be excluded.
- These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there; courts of British Columbia have jurisdiction.
- Our content, branding and designs belong to GenXwest. Deliverables you pay for are licensed or assigned to you as set out in your agreement.
